Next Tuesday Will Tell The Tale In Bio-Solids Dispute

Tuesday, February 14, 2012 @ 11:24 AM

Prince George, BC –  Despite the threat of serious legal consequences, a Salmon Valley resident says he will spend the next week deciding whether to resurrect his road blockade to prevent a planned delivery of bio-solids to his neighbour’s property.

Andy Angele blocked Wright Creek Road back on December 9th to prevent a City contractor from delivering a truck-load of bio-solids to the Arnett Ranch for use as fertilizer.  RCMP were called to the scene; however, the contractor eventually turned back to the city without making the delivery.

On February 3rd, the City began legal proceedings, filing a Notice of Civil Claim in BC Supreme Court.  Angele says he was served with the Notice and an accompanying letter from the City’s legal counsel advising that the deliveries would resume February 21st and that a court injunction would be sought to have RCMP remove any future blockades.  The Notice also outlines the City’s intentions to seek damages and costs from Angele arising from any such blockades, including transportation costs for any undelivered bio-solids and the costs of the legal proceedings.

Angele has 21 days to file his response with the court.  In a preliminary response released to the media today, Angele outlines concerns surrounding his security, health and future earnings on the sale of his farm, should the application of bio-solids go ahead on the adjacent property.  He concludes by writing, "I have no choice but to continue my opposition to this proposed application."

Asked if this means he will set up a blockade to prevent next Tuesday’s delivery, Angele says, "I guess when the time comes, we’ll find out – I’m not sure myself, yet."

"I’m still hopeful that the City officials will read this response and, maybe, reconsider and find another place to put."  He adds, "Maybe they’ll take my offer that I will help them with the trucking costs to bring it to a more appropriate place."

You don’t have a leg to stand on, Andy, you’ll just end up digging a hole for yourself that you can’t get out of.

First thing I would do Andy is file a response within 21 days to the court. Cant play or win the ball game trying to play outside of the park.
Can’t say I don’t blame you for being concerned about that crap, have been in the area of simular stuff, terrible foul smelling.
