City In Court Today In Haldi School Rezoning

Thursday, April 26, 2012 @ 4:46 AM
Prince George, B.C – The City of Prince George is in court today and Friday, defending the rezoning of the former Haldi Road School. The rezoning cleared the way for the former school to be developed into a residential Recovery Centre for Women.

The case against the city has been filed in the name of one resident. It calls on the Court to rule the rezoning invalid based on three arguments:

1. the rezoning is inconsistent with the Official Community Plan for Prince George,

2. regulates users and not the use of the land and that

3. the City cannot amend the official Community Plan without complying with the procedures required under the Local Government Act.

Council for the City of Prince George approved the rezoning after the proponent put up a cash security for some off site works, and a covenant was registered against the property. The covenant prevents the proponents from using the on site well for the Recovery Centre’s water supply, instead, the Centre will have water trucked in, and will store it in one of the cisterns on site. Water use was a key issue with the area residents who say the planned centre would put unnecessary pressure on wells in the area.

Wonder if the City will understand the rule of law..
Cheers

Good Luck Haldi Residence. People need to realize it is a residence that was rezoned.

City hall knows the rules, just ask the people who wanted Coyotes opened, city hall just seems to remember ther is a law when it suits them and ignores it when it doesn’t. Another item that shows Green should NOT be mayor, and council should be ashamed of themselves.

Seems to me that the City was in this mess prior to Green becoming Mayor….

Getting into a deeper mess isn’t what the constituents voted for. I think we have another Christy Clark, and I also think Sheri is going to be just as hard to get rid of.

Yes this was an issue BEFORE Green became mayor, but she was still on council so I’m curious as to how she felt in regards to this.

The City was in this mess in the mid 1970s … I had to scratch my head when they tried to stop an adult store from opening in PG through refusal to grant a business license for an adult store.

The City took that all the way to the Supreme Court of Canada and the City lost.

Maybe we just have poor legal advice here. We’ll find out eventually how this one turns out.

It must be fun to spend other people’s money for the mistakes you made.

“stop an adult store from opening in PG”

Obvious that the city wants exclusive rights to that part of our anatomy. Ben Dover….paging….Ben Dover.

“BEFORE Green became mayor” Were not the proponents of this facility backing Shari’s mayoral bid in a Major way.

Yes it was an issue before Green was mayor. The fact is, look on the city website video and it appears Green was the one that was pushing this in before the election.

Khoeler was asked by the Haldi Road group what his take was on the rezoning and he sent an email back to them saying that it was before the courts – during election time when it was not…………

As for “having fun to spend others people’s money” It was the city that requested a two day trial and not the Haldi group – they asked for one…..

There were only a few councilors at the time that actually took the time to meet with the residence of the area. And, only a few that were running for council at the time of election. Maybe the next time people running will get knowledge with the issues at the time of election and not vote with the status quo……….

Good luck to the Haldi neighbourhood, it is OK to stand up for your beliefs and rights. The old saying goes “sticks and stones can break my bones, but names can never hurt me” There have been enough name callings over this fiasco……

or put another way…. Marshall the Wood for her election platform;-)

Sure hope the Haldi Road residents get a few bucks on the side considering the bad mouthing they received by being labelled NIMBYS. Talk about character assassination. WARNING! Do not rock the boat, lest you be labelled.

I just wonder how much of OUR tax money the city is going to spend trying to push this through???

Give more – the Haldi Road residence pay “OUR” tax money also……….so where is the justice in paying one way or the other?

Harbinger – The residents will get sweet diddly squat. But at least they can say they did not lie down and take it…….
