WorkSafe BC Forwards Sawmill Files to Crown

Prince George, B.C.- WorkSafeBC has just announced it is forwarding its findings of the investigation of the two fatal sawmill explosions and fires to Crown for possible action.
 
 WorkSafe BC says it is not   recommending any criminal charges, rather,   they are asking Crown to review the cases to see if there  should be charges under the Workers Compensation Act.
 
It will be up to the Crown to decide if charges under the Workers Compensation Act would be laid.
 
It has been stressed these are not criminal charges.
 
Those charges could include violations for supervision, training,   and  failure to provide safety to workers. WorkSafeBC is not being specific on possible violations in these two cases and the possible actions could be against people as well as the companies.
 
4 people died and  more than 40 workers injured in the two  explopsions and fires at the two  mills.
 
If the Crown proceeds to court, the consequences could be administrative penalties, the Court could also impose a penalty and or imprisonment.  The maximum  penalty through the Court is  a fine of $652,000  and /or a maximum 6 months in prison. 
 
Files have been referred to the Crown in the past and in some cases, Crown has   decided to proceed, there have also been cases where Crown has not moved forward on the cases.

WorkSafeBC has completed its investigations into the explosion on January 20, 2012 at the Babine Forest Products Company in Burns Lake and the explosion on April 23, 2012 at Lakeland Mills Ltd. in Prince George. Two workers were killed and 20 injured in the Babine mill explosion. Two workers were killed and 22 injured in the Lakeland mill explosion.

Pursuant to Division 15 of the Workers Compensation Act (“Act”) WorkSafeBC has made the decision to refer these matters to Crown Counsel; to that end material is now being prepared.

WorkSafeBC has released safety information as it became known during the course of these investigations. This information has been shared with industry and is posted on the website at www.WorkSafeBC.com.

Any word if the mills will be rebuilt?

DPJ – the conspiracy theorists would tell you that the rebuilds are dependant on whether charges arise or not…

Not enough wood to rebuild but if they do others will be shutdown.

So worksafe has the information that can save other mills and people and they wont release the information? they should go to jail for this

I do not think that worksafe is the only body that has the information.

They are strating construction at Babine this spring, Lakeland next fall. I heard the Worksafe spokeswoman on the radio. Sounds like a rather vicious individual. The background of virtually every crown counsel is a liberal arts degree prior to law school. I’d wonder how any one of them can comprehend the information contained in a massive compo report like this one…
