NDI Trust Versus Commonwealth Campus Continues

Prince George, B.C.- A brief appearance in the Prince George Law Court building today for representatives acting on behalf of the Northern Development Initiatives Trust.
 
NDI Trust has launched foreclosure action against Commonwealth Campus Corporation over the loans it provided to Commonwealth Campus to purchase a number of properties adjacent to the former Prince George Hotel site.
 
NDI Trust made a Chambers application today to have Joanne Gialleonardo named as the representative for the Estate of the late Dan Gialleonardo. He was one of the Directors of Commonwealth Campus which borrowed  $1.4 million dollars from NDI Trust.    Joanne Gialleonardo was served with notice of the foreclosure action a month ago but has not yet responded to the court action.   The application was granted.
 
A second application was withdrawn, as it called for the court to allow a process server to deliver legal documents to the home, or office of two of the respondents. The process server had filed an affidavit with the court saying she believed the two were deliberately avoiding her. The two, Commonwealth Campus President, Dan McLaren  and Director Gordon Langer, were   only served last Friday, after several attempts to deliver the documents had failed. Since they have now been served, the application was withdrawn.
 
Four others named in the court action, Don Kehler, Heather Oland, David McWalter and the Estate of Gialleonardo have already been served. The four were directors of Commonwealth Campuses at the time of the loan, and, according to the petition filed by NDI Trust, had provided personal guarantees for that loan.
