Cluculz Lake Case Against Pool Referendum Dropped

Prince George, BC- The court action to overturn the results of the Vanderhoof pool referendum has been stopped.
 
Organizers of the court action have had their lawyer file a “notice of discontinuance” in their case against the Regional District of Bulkley Nechako.
 
Randy Holubosh says the decision   to drop the matter came just days after meeting with their lawyer, a meeting which initially had the team pumped to press on with the case.
 
At issue is the referendum which numerous voters in Electoral Area “F” say was unfair. There were issues about mail in ballots, and notifications.   The referendum passed, and that result means   residents of Cluculz Lake and electoral area “F” will be required to pay $1.00 for every $1,000 of assessment annually to cover the operating costs of the multi million dollar pool to be built in Vanderhoof.
 
Holubosh doesn’t want to outline the details to media of why they are dropping the action, as he says it is important the residents hear the details first.   Holubosh says finances are part of the reason for dropping the action, but their lawyer also advised they may not be happy with the decision by the court.
 
A special meeting is set for this Saturday at the Community Hall on Lund Road.  
 
The meeting will detail the reasons for the decision to drop the court case, the strategy moving forward and the financial status.  Those  who made direct deposits to the campaign fund are asked to bring a copy of the deposit slip.
 
Saturday’s meeting is set for 2 p.m.

Forget the lawsuit. They should incorporate into their own municipality. If they did that, they wouldn’t have to pay Vanderhoof’s tax bill.

One could just as easily say “must be a poor lawyer, he did not know the law well enough to see how to win the case.”

As they say in the case of ALL professionals, seek a second opinion in either case.

I agree with Icicle. They are far enough away from Vanderhoof and likely have considerably different issues that they ought to incorporate.

Translation: Your case is weak.

Translation: The system is set up in such a way as to make it difficult to fight injustice brought on by those in office.

Yeah, blame a weak case on ‘the system’. Sounds about right.

Well then, please tell us why their case is weak almighty one?

One only needs to look at the fact that the residents have dropped their case. You would think if there was any hope whatsoever, it would be full steam ahead.

JB, maybe there is a more cost effective approach for the residents to proceed with.
1)Since a large portion of the funding required is from the BC government(and election approaching), what stance to each of the candidates have on supporting a ‘want’ while there are shortfalls in many ‘needs’.No provincial or Federal money equates to no pool.
2)Maybe Cluculz residents can ‘incorporate’
3)Maybe split up area ‘F’ so that the two distict communities can have their needs and wants met for their hard earned tax dollars. Kind of like a ‘Cluculz Lake accord’…

…in your opinion. The residents should have made their feelings known long before the vote, rather than raising their concerns after it didn’t go the way they wanted. Time to move on.
