BC Court Of Appeal Sides With City Of Quesnel

QUESNEL, B.C. – The City of Quesnel is pleased with the recent decision released by the British Columbia Court of Appeal upholding the decision of Mr. Justice Nathan Smith of the B.C. Supreme Court to dismiss the lawsuit filed by Gook Country Estates Ltd against the City of Quesnel and members of City Council and City staff.

The lawsuit challenged a number of decisions and acts involving the City that were in connection with land being developed by Gook Country Estates Ltd. and companies associated with Victor Newman. Allegations were made that the City unlawfully approved the extension of a waterline, and that staff members abused their authority in the subdivision approval process. Gook Country Estates Ltd. also challenged the lawfulness of development approvals issued by the City for some of the buildings in the Newman development.

The suit was dismissed on Sept. 13, 2006 on the grounds that “The plaintiff has failed to show that it is entitled to any of the declarations sought and the action is dismissed.” This decision was appealed by the plaintiff, but dismissed by the Court of Appeal on October 10, 2008.
