Court Orders CN To Deliver Video of Prince George Crash

Prince George, B.C.-   A B.C. Supreme Court Judge has ordered CN to give Transport Canada  a video of the August 4th, 2007 crash of two locomotives 
on the east side of the Fraser River in Prince George. ( at right,  photo shows locomotives and burned rail cars.  It also  shows  the boom in the water, as well as  screening on the  bank to prevent contaminated soils from entering the river   photo, opinion250 file)
The video had been recorded by a camera on a pole. The video had been transferred to a cd and CN considered it part of its internal investigation and did not want to give it to Transport Canada.
In his ruling, Justice Dean Wilson said since the video had not been shot from the inside of the locomotive, the railway’s claim of statutory privilege did not apply. He did rule however that other documents collected by CN should not be released as they fall under litigation privilege.
The crash on the long weekend in August caused an intense fire which burned vegetation from the tracks down the bank to the Fraser River.   The flames burned two tanker cars carrying gasoline, one of diesel fuel and a load of lumber. Some diesel fuel made its way to the river, and there was soil contamination. No one was hurt in the collision and resulting fire.
The crash caused Transport Canada to put in place a set of orders on how trains are moved from the First Avenue yard to the BCR site.   While CN has put the crash down to human error, Transport Canada has yet to release its final report on the incident.

CN won't give up the video. They are way above BC laws and Courts.

I wonder how much contamination or polution happened and if there is any trace left?

You expect CN to tell the truth. Not likely especially when it was clearly their own fault for incorrect handling of the cars.
Interesting to note that this incident was the fault of the previous Prince George superintendent.He was the one controlling the remote control switching engine when the accident happened.He was also warned many times not to take too much tonnage down that grade(buy the people who work that job regularly) as the remote control locomotive can't handle it.In fact one week prior to this accident the very same thing happened with the same individual at the controls with a less dramatic result.Had this been a unionized CN employee he or she would have been fired and charged for all the evirormental damage.Where is the superintendant now? After one year demoted to an asst. superintendant in the U.S. he is now a the superintedant for all of Alberta!!!
I feel that the person coastb has named as responsible should be given a break.

Fine. The guy made a big error. However, how long has he worked for CN? How was his work record prior to, and since the accident? What remeadial steps has he taken to ensure that something similar like this does not happen again?

Its just like any job. To screw up is human. Sure, you get reprimanded, get transferred, get demoted...but who's to say a person cannot learn from a mistake? It should not prevent this person from rising within the organisation to which he has devoted many years to.

CN should be held accountable for allowing incompetent people to move dangerous goods thru cities and towns.
You know what they say if your incompetant at your job. Promote them. That way you get them out of making mistakes like this, and make them administration.

If CN is willing to protect this person, than CN should have to foot the bill.
As I stated earlier this man was warned numerous times not to make this switching move.He was warned by the people who have worked that job for years.Also as I had stated earlier if it had been a unionized employee who had done this he would have been fired by the superintendant.The superintendant shold be held to a higher standard than the people he supervises.He had ordered the regular men on the job to preform this move earlier and they refused as it was too dangerous.He then made the move himself,the result was a runaway that ended up in the very spot the sideswipe had happened.Any one else would have learned their lesson.What does the superintendant do one week later?The exact same swithing move with the exact same result.Except this time a train is arriving and the result goes down in Prince George history as one of the worst disasters to ever happen here.
Does he deserve a second chance?I think he got it earlier and blew it big time!The entire safety of this region could depend on the decisions made by this man. history shows he is not capable of making the right decision at the right time.
Don't even get me started on his involvement in the Lillooet Sub runaway that killed to employees!!!

I heard a version similar to that told by coastbee, except without all the juicy details. The gist of the story I was told was that while it was a supervisor who crashed the train, he was under pressure from those above him to get more done on that shift, and that they were shorthanded that day.

I would like to confirm that what coastb is saying is correct. This supervisor should be held accountable for his actions just the same as the unionized employees, I would like to hear CN explain to the court why they shipped him off to the US shortly after the incident
I would like to confirm that coastb is an idiot. I agree that there should be discipline just like my brothers and sisters would be but the guy got disciplined for a year, how long do railway employees really get disciplined. My experience is not long...maybe three months and normally get all their pay for that period. Did BCR have any incidents in the past that people don't know about? I heard a few years back they had a major propane spill in the same area but no one makes a big deal about that. Give the guy a break -get off your high horse.
