No Charges in Dziekanski Case

Prince George, B.C.- It  has been confirmed, the four officers involved in the Robert Dziekanski  case, will not face charges.

The 41  year old Polish immigrant died moments after being tasered five times in a holding area at Vancouver International Airport in October of 2007.

According to the Criminal Justice branch, prosecutors reviewed all the vidence and found the evidence fell  "remakably short" of that which is needed to lay charges.

Three pathologists say  the cause of death was not  tasering,  rather a result of a combination of factors :  alcohol withdrawal, hysterical fear of flying, lack of sleep and restraint by the officers.

Restraint by the officers? Or officer sitting on his head/neck while Robert has no muscle control. How did the officer expect him to breathe?
If it were you or I that caused Robert's death in this manner, it would be a charge of manslaughter, and the cellphone video would have been used to convict us. A "slam-dunk" if I ever saw one.

I guess manslaughter dosen't apply if you're a police officer, (or murder when a couple of other cases come to mind).

Too bad that dang video that the RCMP tried to suppress, couldn't "disappear" like the ones they have internal control of mysteriously did !

No matter how they try to whitewash it, we all know the truth about this one.

Not that we didn't know how the results of them "investigating" themselves, wouldn't always turn out.

Injustice once again has been served.

Evidence falling short? I thought the video was clear and decisive. Video cameras have of course been known to perjor themselves, or is it purge?

Wow, patheticologists!! Three of them conclusive to the same findings.

Alcohol withdrawal, and there is no way he had a drink on the plane. What is the level of withdrawal that causes death?

He already flew, he was at the airport for hours. No fear left.

Lack of sleep? Even hardcore addicts stay awake for days on end, yet they live to repeat the endeavor.

Should be without saying that these officers exhibited no restraint.

They could of at least cited CBC's findings on malfunctioning Tasers, at least they MIGHT have seemed credible.

Prosecutors make their decisions to proceed or not to proceed with charges in a case based on the information they get from the police.
That is normal proceedure I would think.
They could choose to interview witnesses if they wish, but we don't know if that in fact happened here.
But they normally do not investigate a case on their own as I understand it.
It isn't like CSI on tv.
Obviously,the RCMP itself had a vested interest in these officers NOT being charged, so what does that tell us about the evidence they provided to the prosecutor/s? for consideration and the manner and context it was presented?
Was it slanted in favour of the RCMP in any way?
Did the fact that these were RCMP officers have any effect on the decision reached by the crown?
If the crown HAD found in favour of charges against the RCMP,how would that affect the everyday realtionship between the crown and the police, who are generally considered to be on the same side?
How would it affect the RCMP in the future in cases where officers are accused of using excessive force as they often are?
Sometimes a little too often?
Is discharging the tazer five(5)times not considered excessive force?
Seems to me that there are still a lot of deliberately unanswered questions that relate to the conduct of the RCMP themselves, in the manner they handled this case right from the start and these need to be answered.

Ladies and Gentlemen, the rules are very simple, and those who do not follow the rules will have their comments removed. That is why a couple of comments have been yanked. They crossed the line on the laws of the land.

Youre quite mistaken there freeze. If you think the crown lays charges based upon the vested interests of the RCMP, then you obviously haven't heard about the Mindy Tran Case or the Amanda Simpson case.

The Crown lays charges based on the reports provided to them by the police. They decide on what is given to them, provided by the police. That's all they have to go on. Don't think police reports are doctored one way or the other ? Think again. It is relatively easy to omit small facts or put a slant on them. You can pretty much tailor the Report to Crown Counsel to suit your needs. You can even have your resident legal expert go over it before you submit it to Crown, to ensure it is going to swing your way. Crown makes a decision on charges being laid based on the "substantial likelihood of conviction" and "being in the public interest". Crown has very high tresholds to meet in prosecuting criminal charges (beyond reasonable doubt) and it is easy to discourage a prosecution where you don't want one.

I suspected alcohol withdrawal was the cause of Robert's behavior.
I feel the police over-reacted and may have caused his death by their lack of ability to handle the situation professionally.
I wish we could clone you thereasonableman or at least get you to pop kids out left, right and center. You wouldn't mind saving Canada would you?
