In a 2-1 decision, the B.C. Court of Appeal has upheld the conviction of Robert William Pickton on six counts of second-degree murder .

Two of the three judges found that trial Judge James Williams did make errors in his final instructions to the jury but the mistakes weren’t serious enough to order a new trial.
All three were in agreement that Williams should not have split the trial in two, hearing 6 of the murder counts separately from 20 other counts.
That unanimous decision means that should this be appealed to the Supreme Court of Canada and the Supreme Court rule there should be a new trial, then the new trial would deal with all 26 counts.
