Dziekanski Death Result of System Failure Says Lawyer

Vancouver, B.C.-  The closing arguments in the Braidwood inquiry have begun and the lawyer for the mother of Robert Dziekanski was the first on the list.

Walter Kosteckyj  says Dziekanski’s death came as the result of systemic failure. He pointed to the lack of translation services and failure of YVR policy which left an unseasoned traveller frustrated and alone.

Although the RCMP officers who attended the scene deny having discussed how to deal with Dziekanski before arriving at the airport, Kosteckyj said the officers presented, at best, a “premature, hurried and packed response and at the worst a premeditated and planned attack.”

Dziekanski died after being tasered five times.

Kosteckyj urged the Province to move to its own provincial police force as the RCMP doesn’t see itself as accountable to the Provincial Government.

Kosteckyj was the first of 15 lawyers who will make closing arguments to the Inquiry. It is expected it will take until the end of the day Thursday for all closing arguments to be presented. If need be, more will be heard on Tuesday of next week.

Dziekanski Death Result of 5 premeditated tazer discharges in 2 minutes plus having his breathing restricted by a knee on his back in the chest area.

Get out the shovels! They will need many for the used hay being flung about and to bury this as deep as they can.
This won't be popular, but what about Mr. Dziekanski's role in this? If he hadn't flipped out in a secure area of the airport, he'd be alive today.
MrPg--you obviously don't know what you are talking about. Get educated--if you have enough brains !!
I told ya...
Get Out Of British Columbia R.C.M.P
Well, the 5 cops would have signed off proof that they took compulsory training prescribed by Taser International, that recommends limiting use of the device to "10 seconds" except where prolonged use is "necessary." TI doesn't specify, but suggests that officer safety is the major concern.

Okay, but 1 cop - aided and abetted by 4 others - discharged the unit for "31 seconds." Why would that not be excessive force, executed with malice? Then there is the fact that the cops all spewed co-ordinated deceit that Dziekanski "violently resisted" apprehension, by writhing in uncontrolled agony as 50,000 Volts ripped through his body. Only the morally bankrupt would deny that he was in no position to resist. Again, TI training lists a typology of resistance.

Then there is the fact that the 5 discussed use of the Taser, prior to being in position to assess the scene.

Include Accession to Common Assault, as an aspect of "systemic failure." Note - the AG's charge assessor - Stan Lowe - in this case, is now head of the Office of the Police Complaint Commission. The BC Civil Liberties Assn is boycotting all co-operation with that vile entity.
MrPG, you have not a clue!!
All 4 RCMP involved with this killing should be hung by their necks until death do they part, IN PUBLIC. They are a disgrace to anything Canada should stand for!!
I don't know about actually hanging these four wonderboys taxinapothole,(hmmm...)but at the very least, they must be removed from the force and criminal charges for manslaughter filed against them!
It would also be nice to see some of their lying superiors turfed out as well!
Unfortunately,my logical side says they will walk.
All of them.
The solution may in fact be to remove the RCMP from B.C.and put a provincial police force in place.
They are not accountable to the B.C. government anyway, and that may very well be a big part of the arrogance we see from them on a daily basis.
I like the idea of a provincial force and now is the time to do it before we renew the contract!
Of course, the provincial government will tell us we cannot afford it, when in reality,it is this provincial government we cannot afford!
