“A Conservative Victory in Court for Taxpayers”

Here’s a court battle involving Elections Canada and the Conservative Party of Canada that you likely haven’t heard about.

No, I’m not referring to the much-publicized court challenge between Elections Canada and a number of Conservative MPs, including myself, over the interpretation of election advertising rules in the 2006 federal election.  That issue is still before the courts.

I’m talking about a court action by the Conservative Party against Elections Canada to prevent Rebate Double-Dipping.

Rebate Double-Dipping occurs when a political party collects BOTH a GST rebate and an Elections Canada campaign rebate for the same expenses.  Imagine you, as a taxpayer, being able to claim the same expense twice!

The Conservative Party opposes Rebate Double-Dipping while Elections Canada has defended it.  For 16 months, the Conservative Party has been trying to return our double rebate to Elections Canada but they wouldn’t take the money.  We refused to use the double rebate and placed it in trust.  This may be the first time in history that a political party went to court to try to give money back to Elections Canada.

On December 31st, the Ontario Superior Court of Justice accepted the Party’s position.  This means that the Conservative Party’s 2004 and 2006 election returns will now reflect the GST rebates it received.  This is good news for taxpayers who should not be burdened with supporting political parties twice for the same expenditures.

The court victory for taxpayers made little news and there’s no word yet on whether the other political parties will be returning their doubled-dipping rebates.

Another piece of Elections Canada news within that same week was that six Members of Parliament who ran for the Liberal Leadership in 2006 have missed the year-end deadline to repay loans made to their campaigns, even after Elections Canada granted them an 18-month extension to pay their debts.

The extensions for Stéphane Dion, Gerard Kennedy, Martha Hall-Findlay, Maurizio Bevilacqua, Joe Volpe and Hedy Fry came and went on December 31st.  A Liberal Party spokesperson blamed the constant need to be prepared for an election in this minority Parliament for the former leadership hopefuls’ inability to to pay off their loans.

I’m left to wonder if this was a suggestion that the Liberals are choosing to focus fundraising efforts on future election campaigns rather than complying with the law.  Regardless, the Conservative Party’s position remains unchanged.  We simply want consistency in the application and interpretation of electoral law for all political parties and we will continue to make our case both in and out of the courts.

On another note, a typical Parliament is comprised of several sessions and therefore several Throne Speeches.  Prorogation has previously occurred 104 times in order to launch a new Throne Speech in the same Parliament.  On average, a session has lasted about 109 House of Commons sitting days…this last session of Canada’s 40th Parliament lasted 128 days.

To prorogue Parliament is routine and right now it’s important as Canada enters the next phase of our Economic Action Plan that maintains economic stimulus while working towards a return to balanced budgets as quickly as possible.

On another note Jay....Get back to work. You make it sound like prorogation is a wonderful thing. Its just a tactic used by your party to help avoid being accountable, and guess what, no matter how much spin you put on it, the polls confirm this.
The tax payers may have one on this LITTLE ITEM but in the long run we are being scammed, ripped off and lied to continuously by your party. You can spin it however you like. The liberals are thieves, liars and are selling BC off to the highest bidder. The Olympics is a prime example how British Columbians never had a voice. The 7 billion dollars that we will owe by the time your party has done partying will destroy BC and it will never be the same again. Let us not forget the headlines of yesterday that tells us that our medical waiting lists are being stuffed full of people from other provinces. We pay and wait while others give you money to move in line ahead of us. Shall I mention that 90% of British Columbians DO NOT WANT the HST! What about the Carbon Tax that was forced down our throats while anyone who lives any where else on this planet pays nothing and the embarrassing tar sands sit right in our back yards. And do any of you puppets ever think about what our municipalities are doing to us as well. Raised taxes every year for the last four years by the regional district and the city. We are being screwed and tattooed on every level of government! The utilities which THE PEOPLE own are all whining and threatening to increase rates. The cost of groceries is out of this world. The people are on to you and as every day passes more and more people wake up. Enjoy your high paid seat while you have it because I am absolutely sure that we will not have to listen to your propaganda after the next election. Crawl out from Campbell’s butt and actually work for the people who pay your wages. I am sick to death of your rhetoric.

To put a spin on things by comparing regular routine prorogations to the two recent desperation prorogations in our Parliament are really highly disrespectful of the intelligence of the voting public out there, in my opinion!

Unbelievable! Get back to work and let the committees complete their work!



Municca....these comments are about Jay Hill, MP (Conservative) in Ottawa, not the Liberal Party in Victoria....perhaps Ben can do a story on the Provincal Liberals and your comments certainly will apply to that.

Different pile but same crap! Federal = Provincial. Our Provincial government gave the Federal government the reins. The Constitution USED to read that the Federal government could not tax the people directly, that was the Provincial Governments job. Starting in July we will be run by the Federal Government so why do we need the Provincial level? They obviously do not want the job.
Strange how both of our conservative parties are accumulating more debt than the 'left of center' parties they replaced. Historically the federal liberals have done a better job than the conservatives, and the new 'structural' deficit of 18 billion is the proof of that. Why is it that this economist continues to support reaganomics - which didn't work by the way?
It's kind of clever - they don't have public support to cut programs or their employee's wages/benefits - but they give us a GST tax cut (which we the dumb masses like, even though we can't afford) and then cut programs because we can't now afford them. The 'liberals' have almost doubled the provincial debt and have now sold us down the river with the HST (and don't get me started on the Olympics that El-nino is now about to ruin). We need a third party - and now.

Not really. I don't think it would matter who was in control during the world economic crisis, we'd likely be in the same boat.

I'd like to see less government and less services, but that's a hard sell in a socialist country like Canada, where it's expected that the government take care of everyone from cradle to grave no matter the situation.

Andyfreeze, right on! If we don't object to these blatant manipulations of the democratic process our geese will be cooked! No political leader should be tolerated who is afraid to face the criticism of the democratically elected opposition, imho!
I wonder if Iggy, on his cross country ivory tower tour of a lot of universities will honour UNBC with a visit? Hope so. I would like to ask him if he really is "just visiting" like they say.
You guys have to cut the Conservatives some slack.

It takes a lot of intestinal fortitude to put up with the Liberal, NDP, and Bloc on a daily basis. Just think about it for a moment. Constantly being bombarded by the imcompetant whining of Iggy, Jack (the talking mustache) Layton, and Duceppe the high paid Federal Separtist. Good God, how much of this type of BS does one party have to take.

The **Big Break** that Harper has given Parliament, and the Canadian people is a blessing in disguise. Just think two whole months when we dont have to listen to any babbling politicians.

On another note. Anyone who thinks that this little break, will effect the Conservative party over the long haul is sadly mistaken. This Country needs a leader who is not afraid to take some flack in order to get the job done.

This is the first time in many many years that we have a Prime Minister who is not only intelligent, but has the wherewithal to go against the grain. Much better Harper than the likes of the other three stooges, who even if you threw in the thinly disquised NDP's wanna be Liberal Leader Bob Rae dont amount to a hill of beans.
