Doing a ReThink on Drinking and Driving

Prince George, B.C.- New sanctions are now in effect for drinking and driving in B.C. and while many of us may think we know “our limit” do we really?
The Meisner program on CFISFM conducted an experiment this morning live on the air. Over the course of an hour and a half,  Ben Meisner, the show’s host, and J.D. Boutillier the producer of the program,  consumed about the same amount of booze as one would have over an extended business lunch.  ( click here for a video of the event)
RCMP North District Sergeant Pat McTiernan, and Prince George Detachment Sergeant Al Steinhaueser were on hand to monitor,  discuss, and administer the breathalyser testing.
Ben   was drinking vodka, J.D. had beer. In each case,   Ben’s drink was a single shot of Vodka with 4 oz’s of orange juice. J.D. had a can of Coors Light beer.
8:30. Ben and J.D. each had   one drink.
8:40: Just ten minutes after  having   their first drink, the first breathalyser was administered by Sergeant Pat McTiernan of the RCMP.
·        Ben’s reading was  .004
·        J.D.’s reading was  .013
8:45: Ben and J.D. have their second drink.
9:05: Second breathalyser was administered,
·        Ben’s reading was .006
·        J.D.’s reading was  .019   J.D. is noticeably giddy
9:15: Both men have their third drink.
9:30: Third breathalyser  is administered:
·        Ben’s reading is .013 Ben’s face is flushed, although well within legal limits, he says he knows his ability to drive is impaired.
·        J.D.’s reading is .037 J.D. says he feels “fuzzy”
9:35 both men have their 4th drink
9:45 Fourth breathalyser is administered
·        Ben’s reading is .020
·        J.D.’s reading is “WARN” which means if he was behind the wheel of a vehicle, he would have had his vehicle impounded for 3, 7 or 30 days depending on his past record
Another ten minutes passes  without a further drink. Both men undergo a final breathalyser:
·        Ben’s reading: holds at .020 Sergeant Steinhaueser says he has noticed that while Ben has been writing notes, the  notes are become less legible.
·        J.D.’s reading is still “WARN” J.D. has trouble providing a deep enough breath and feels dizzy afterwards, surprisingly, J.D. says he feels “better” now, and says in different circumstances, he would have waited 10 minutes before driving home “and that is horrifying” says J.D.
Sergeant McTiernan says J.D.’s current condition  is the real danger zone. “This is not the sleepy fall over drunk, this is the person who is feeling a certain level of confidence, and will take a chance.  This is the person we want to make sure we take off the road because they will speed, they will cut someone off, they will think they can out run the police, they will run a stop sign and T-bone someone.”
McTiernan says if a passenger plane crashed in the city killing 58 people society would be in shock and outraged, yet, society seems to accept that it’s o.k. for 58 people to have died in crashes on the highway in North District last year.  “That is not o.k., and that is what this ( the new sanctions) is all about, trying to reduce those crashes, and trying to keep those people off the road who could cause harm to you or the ones you love.”

Guilty without the benefit of a trial. That's scary. The irony of the whole thing is that the RCMP now has rights not seen since the 40's...These are the same people who killed a lost man at the Vancouver airport; shot and killed a man in a field in Vanderhoof; shot and killed a man in the back of the head in Houston, killed a motorcyclist (then claimed to have gone home and had a few drinks) in the GVRD, etc. etc. etc...

Yeah, let's give them absolute power...
These are very harsh consequenes for not breaking the law. Is .08 still the limit or did I miss something.
I for one am very glad to see these new drinking and driving laws. Drinking and driving kills. Period. Anything that can be done to get and KEEP drunk drivers off the road is good news.
you're missing the point daisybee. .05 is nowhere near drunk--as a matter of fact, niether is .08. It's about power and control; remember Hitler?
Sergeant Pat McTiernan is not a specialist in this field of medicine, nor is one test with two people who may or may not have any immunity to alcohol. Poor test, poor testor, poor testees. Useless information and no truth in it. Just like the shooting in the airport; fabricated by those who are there to control you. Ha
Everyone is different but what I saw here was JD drank 3 beers and was under the limit. He drank 4 and was at a warn. So does this tell us you can have 3 beers and drive. Doubt full.. I've seen people who seem plastered after 3 beers
Several of you are not doing your homework or listening to what the new Provincial law says. You are condemning the police but they do not decide the penalties (not fines). It is the Superintendent of Motor Vehicles who is giving the penalties out. Some may call it another "cash grab" for the government. The police are only the first step, after that it is the Government who are making the decisions and penalizing the people. If these laws stay, then the City of Prince George should be going after the cab companies who do not put enough taxies on at night for the ones who have had too much to drink. Also utilize the vans that certain pubs are supplying to their customers. "Times are changing". We are all saddened when someone is hurt or killed by a drunk driver but it seems to be "sociably acceptable" to drink and drive. That "attitude" is catching up with society. Norway and Sweden have "zero" tolerance. Food for thought. It is only a matter of time before this law ends up in B.C. Supreme Court. It will be an interesting decision that the Courts make.
What do you folks think of the random tests. Cops judge and jury.
Blah Blah Blah, If you don't want a fine, don't drink and drive. It's that simple.
Oktoberfest is coming up at CN Centre in early October. Anybody care to guess how many of those people leaving the event would blow over .05?

There should be a battalion of cabs waiting outside after such an event. I had to pick up a family member last year because he said it was going to take an hour to get a cab. That's ridiculous.
The new law... is really a money grab and more important - an claw back on our basic freedoms.

-there are no facts presented leading up to the new law stating how many accidents were caused by those in the .05-.08 zone. The boys just have the over .08 stats. It is said to be a logical extension made by the gang a motor vehicles.

A person could argue that drivers distracted by pets, drivers distracted by their kids and over tired drivers cause just as many accidents as those that had a glass of wine with supper - holy cow just think of the new laws that come out of that. It could happen and why not. In all cases you have done nothing illegal but you can make a law and fine for it anyway.

Ask an RCMP - if we gave you 25 more cops what would be done with them - answer, they would put 23 on the roads to help pay the wages, one on paper detail and one for holiday relief. This law is not the fault of the RCMP (bet they did advise on it tho) but it does give them power to judge and fine for something that is really not
an illegal act at the federal level.

@Supertech. Thanks for the laugh. That has to be the single most unintelligent comment I have ever read on this site...Comparing a situation like this to Hitler's Nazi Germany really demonstrates that you lack understanding and respect for what the people under Hitler's regime went through. Maybe you should visit the Holocust museum and discuss with the people there if their situation bears any resemblence at all to a province adapting a zero tolerance policy for people who drink and drive.
Agree with you 100%, daisybee! I don't drink more than one beer or one small glass of wine when I go out and eat somewhere. But now, I won't be ordering even that one beer or that one glass of wine! Now many establishments can serve a bottle of alcohol free beer - Beck's tastes pretty good!

I have been obeying society's laws for my own good and for the good of society. It's not any different than driving on the correct side of the road and obeying speed limits, stop signs and seat belt laws.

It has absolutely nothing to do with what dictators like Stalin, Hitler, Mussolini, Franco, etc did in the past!

None of them could be voted out in an election because there was only one party to vote for! Pity the poor people.

Here, as in all democratic countries, if we don't like the party in power we can vote it out of power in the next election.

Yes, thanks for the laugh!

The thought of having to drink a Coors Light makes me dizzy.
Actually, it's kind of nice to know that (according to this test) I can still have my before dinner cocktail & a bottle of wine & still be under the 'warn' level. I can live with that.
But that thought is not measurable on the breathalizer, there for you may continue to drive ... :-)
PG and Daisybee, y'all got yer heads straight.
Some people, well, it takes all kinds to make the world go round, but hitler??
Someone hasn't lived in a third world country yet I guess.
Just remember, everybody's physiology is different. Some can have one drink and display signs of impairment and incoherence, some can have three and not feel it, well, they might not, but others see it.
Plain and simple, don't drink and drive, won't lose your licence, your vehicle, money, etc.
When you go to work and say you're a machinist or pipefitter, do you drink there?
So what's so different getting behind the wheel of a ton or two of metal and driving.
Drop the limit to .05 then. This will most certainly be challanged. Punitive penalties when no law is broken will clog an already over burdened court system. No one defends impaired driving, but what was wrong with the previous laws? .08 and your hooped.

The Hitler refrence is just frustration with more perceived infringments on our freedoms. You can debate that these are necessary so live with it or not but there is ligitimate concern when fines and seizures are carried out when no law has been broken.
Nobody's rights have been violated by this law. I think some people are mistaking rights with privileges.

It's a privilege to drive a vehicle on the road, it is not your human right to do so. If you break the law while driving then you lose that privilege until you can prove that you can be trusted again. It's that simple.

If you are foolish enough to drink & drive then the Police have to play the parental role and ground you. But no rights have been violated.

Kidar: Do you have any suggestions? The cab companies spend several hours taking hundreds of people to concerts and special events. Then at closing time, they all want cabs. Right now. Let's see you buy a hundred cabs and hire drivers for them for fifteen or twenty minutes' worth of work at the conclusion of these events. Then let's see how you can get them into the venue, where, for example, they allow all the traffic to come out in double lines at the two roads in and out of CN Centre. And no, sorry but they can't suspend all their customers over all the rest of the city to get all the cabs in there early before all the traffic starts coming out. The trick is to leave the event early but most people won't do that and they are the ones to complain that there aren't enough cabs.
The prohibitionists are wringing their hands.....

I sure hope the teetotallers on here also support the gun registry.
I feel this live-on-air "experiment" was irresponsible on the part of both Opinion250 and the RCMP.

It worries me to think that people are going to slam back 4 drinks in under an hour and a half and believe they're only a quarter of the way to being legally impaired. (I'm still unsure what this warn level is supposed to be).
The Law of the Land (Canada) says .08, so enforce the Law, don't make up new once for every Province, change it to .05 for the whole Country if you think this is the way to go, but this everyone got is own Idea of a Limit is nuts, the same as having 10 Driver Permit, it's all about screwing us around .
Lets expand this idea furthur. Next thief thats get caught doing a B & E, gets 30 days in jail immediatly 2nd time 60 days, immediatly, etc. If we want this as a society, lets go get em all and let God sort it out. Sure would help the overburdened court systyem
Weaksauce
Just because someone doesn't drink and drive doesn't mean they don't drink.
The registered firearms are locked up in the basement. Though if I was a police officer I would assume there was a firearm behind every door, whether the computer says so or not.
This is a bad law... a violation of a persons rights on many levels. We have courts for a reason, and once we start allowing the police to bypass judicial accountability we create future violations of innocent peoples lives. One ignorant cop can ruin a persons life if they look at him wrong, or say the wrong thing, irregardless of if said person was drinking or not.

I was once issued a 24-hour notice for being tired and then subsequently irate.

It was 3am on my way back from Calgary and they had a road stop on the BC Alberta boarder... I was asked to get out of my vehicle while they searched it for drugs (I had none)... I was asked to walk the line and touch my nose ect... I was perfectly fine and hadn't had a beer in over 24-hours... the cop said he didn't need a breathalyzer because they are trained to recognize if a person has been drinking through their behavior when interacting with the police (ie challenging their authority)... I was told I was 'lucky' to get a 24-hour road side suspension (in the middle of now where) as they could have towed my truck to PG at my cost... I told them that is what I wanted them to do so I could at least have my day in court... they gave me the 24-hour based on 'appearance' only and claimed the closest breathalyzer was in PG.

A 24-hour is similar to this new law and is not subject to judicial review and can not be removed from your license once issued... it is a tool to abuse a lawful citizen that objects to his rights being violated, and is an enabling legislation for a future police state and its police state tactics.

Its a very bad law with horrendous future implications to all of our freedoms and rights under the rule of law.

If they wanted to strengthen laws against drinking and driving then by all means... but don't do that while taking away a persons right to the protection of the law when innocent of any crime.

You bet its a violation of ones right when they are deemed guilty without any opportunity to challenge that. I can't see this law standing up to a court constitutional challenge.
If they are hassling you without making you blow the breathalyzer then you have a legitimate argument. That IS abuse of the system.

I would ask this in any case and encourage others to do the same... when was the last time the breathalyzer was calibrated? Plus it would be a requirement of the Officer to produced the documentation of said calibration after blowing.
Hell just froze over, I agree with Eagleone and he didn't blame some zionest conspiracy. This is killing a fly with a sludgehammer. Like I posted earlier, if we want this as a society, lets expand this to all behaviours we want to stop. Throw all crimes in jail immediatly. Why stop with non-lawbreaking .05 drivers. How about bikers/gangsters put away for 5 days when ever out doors. Politicians who lie for 30 days...immediatly, with no recourse. This is a slippery slope folks. This is not about impaired driving. This is about the treatment of law abiding taxpayers being set upon by government, sold under the guise of publick safety. Hundreds of years of legal rights are being thrown under the bus with this. I am no DUI supporter, but if this was applied to all crimes...it would hit the fan hard.
Wonders what the number of impounded cars and charged drivers in Prince George were over the first weekend?
