Prince George, B.C. – The trial of Councillor Brian Skakun got underway at 9:39 this morning, but took a break within 20 minutes of  that start.
It is clear the preparation for this trial has come down to the wire, and within 20 minutes of sorting through documents, the court took a half hour break so Skakun’s lawyer , Jon Duncan, could confer with his client about an affidavit Duncan says was filed just this morning.
It is the disclosure of documents which could see this trial face further delays as Duncan is filing an application with the Court for the disclosure of more documents.
Provincial Court Justice Kenneth Ball is presiding on this case. Judge Ball normally sits in court in Surrey, but was brought in to Prince George to hear this case  to avoid any possibility of a  conflict given the community profile of the accused.
Skakun is accused of breaching the Freedom of Information and Protection of Privacy Act.   At issue is the release of a confidential report which examined the relationship of a former Superintendent of the RCMP detachment and the Manager of Civilian services at the  detachment. The report, which came to be known as the “Kitty Heller Report” found it’s way into the hands of a CBC reporter, and was posted on the internet.
Through the sorting of documents to be entered as exhibits, Skakun sat stoically, listening intently to his lawyer and the Crown.
Meantime, outside the courtroom half a dozen witnesses sit and wait for their turn to be called to testify.

Fer cry'in out loud Jon, get on with it, quit showboating.
Showboating ? Hardly. Everyday in court is money in the pockets of the lawyers. He is just making his income. It has nothing to do with justice, right or wrong.....it is just money. Thank goodness the tax payers are not paying for SKAKUN's lawyer or this circus would go on for months. I wonder how long SKAKUN will pay this lawyer before he realizes the principal of the matter is not worth it......pay the $50 fine and be done with it !!!!
So why are we not paying for Skakuns lawyer? We paid for the two guys charged in the B.C. Rail ordeal. Whats the difference?? He is not a criminal. He has been by the people for the people. I admire his GUTS, but the City should have put a stop to this a long time ago. This circus is going to be front page news.
Brian could always sue the city for the money after he is proven not guilty.
Maybe we should start a 'support Brian Skakun' fund. I'd be willing to donate. You know how to do that sort of thing Ben.
Boon: Spend some time in court and you'll understand. Some lawyers love to draw things out, and yes they make money on it.
Disclosure isn't the problem here.
