11 Booze Related Driving Charges And Still On The Road.

Prince George -  Police have charged a 62 year old man with impaired driving , and driving while impaired , for the second time in three days. To make matters worse he had been prohibited from driving when he was arrested three days ago and already had 8 -24 suspensions for previous offences.

The charges came  shortly before 11pm Sunday , following an accident at the intersection of Oak Street and Pearson Ave , when a vehicle being driven by the man sideswiped an oncoming car.

He failed the breath test at the scene, blowing over twice the legal limit.

On December 12 he was prohibited from driving for refusing a breath test, then three days ago yet another incident.

He is being held in custody and will appear in court today.

He will drive away from the court too... Whats the point in having a justice system with no teeth?
Another prime example of our revolving door court system, thankfully he hasn't killed anybody yet.
we all need to drive around in tanks to feel safe.
I believed the promise of the new government to get REALLY tough on crime and protect the innocent public......of course I should have known better!

This guy should never have been out and about after December 12, and possibly a lot sooner!

Obviously, he will be allowed to do his thing until he kills a person or a whole family with his vehicle!

Then there will be the usual lamenting and hand wringing and more futile cries for somebody to do something.

Lock him up, confiscate his vehicle and crush it and allow the MVB and ICBC to remove his driving license for life.
I've said it before and I say it again, 3 strikes and you are OUT sounds REALLY GOOD TO ME.
So, let's get rid of all of those bleeding heart appointed judges who are not willing to use the tools they have been given.

All the appropriate laws to handle this matter are in place. Mandatory 14 days in jail for a second conviction for impaired driving, although it seems he hasnt been convicted of a first offence yet. In addition he has 8 24 hour roadside suspensions. How is this possible???

ANSWER:: The police have discretionary powers when it comes to roadside suspensions, and therefore, they, not the judges or court system are at fault in this instance.

This is just one of many reasons why Police should not have discretionary powers. Their job is to enforce the law, not play the part of Prosecutor, Judge, etc;

Bottom Line:

If you put every individual in jail who drove around this town with a blood alcohol reading in excess of .08, by the end of the new year you would need to build another jail to hold them. The people who would be incarcerated would be some of your up standing citizens, and of course some police.
This man and all like him need to be driven to the local land fill and have a barrel put to his head and have the trigger pulled. This man is a murderer just waiting to strike. If he was packing a weapon we would have had him marked as a dangerous offender a long time ago. Better yet lets just let him wipe out someones family so that they can lose it and kill this bastard and then we can make another criminal out of an innocent person. I am tired of this bleeding heart bull s&*t that society has become. Time to get tough on repeat offenders.
I was under the impression that roadside suspensions were given when the blood alcohol level was between .05 and .08. It is not an offense until it reaches .08 but the law presumes a person should not drive with .05 because is too much alcohol. That is, to me, a rather stupid law. If someone should not drive with a level of .05 then it should be an offense to drive with anything above it. The limit for blood alcohol needs to be set at .05, otherwise it is a joke.

Palopu is correct. Police should not have discretioanry powers in this area. Set the limit at 0.05 and charge everybody who drives with a level that is above it. Who they are should mean nothing.

If that man blew twice the .08, that is about .16 then he was blotto and should be convicted this time.

I am not up on court procedings, but can the common man findout what happened at the court proceedings of the day?

I would love to attend this but don`t know where to go to sit in the audience. I would like to better understand where this gentlemen of my cohort is going to be for the next while.

Anyone who drives around impaired enough to warrant a roadside suspension(again and again, in this case!)is not an up standing citizen, but well on the way of becoming a common criminal.

Can the police be sued by relatives of drunken driving victims for abusing their discretionary powers by letting these idiots back on the road over and over again until finally something goes awfully wrong?



Come on people be nice he just made a mistake. Oh sorry that was the line our Premier used when he got arrested for impaired driving. Taser this bastard before he kills someone. He does not deserve is day in court.
It's time for us to stop bitching to ourselves and start demanding our politicians fix what's wrong with our justice system.

This man's behavior certainly creates difficulties for those of us that do drink and drive.

Soon we won't even be able to take an aspirin and drive.

I think we all recognize that the level of skill required to drive the ordinary auto around town is so low you can't tell if people are drunk or not. In the winter time no one can afford to stop because the auto will just spin so you can't get going again, so the only ones that do stop are probably drunk or on the low end of the skill set. It is very rare to see anyone that is capable of using the merge lane in this town, so it is really confusing as to just which ones really are impaired.

The drunk in this story finally bumped into someone, but on the same day how many "unimpaired" idiots had accidents?

I tend to drive super careful when I've had a couple drinks, but then alcohol affects the mood of different people in different ways. Kind of like Road Rage, some people just have trouble controlling their temper. Since bad temper is responsible for most accidents, I wonder how long before Roadside checks for bad temper will be introduced. Looks like lots of failures and roadside suspensions will be handed out to the people on this post.
You have to have a law that separates them from their vehicle in a permanent manner, which cannot be overcome or cheated.

i.e. -Seize the vehicle and dispose of it, as part of sentencing for chronic offenders.
This is the type of chronic drunk that causes fatal accidents, not the "over .08" or close thereby.

This guy hasn't caused anyone's death yet. We have the opportunity right now to prevent it from happening. We have the opportunity to intervene and stop what we know is inevitable, from happening.

How do we accomplish that ?

Why do people in Asia ride bicycles to work ?

They don't have a car.
The car should be seized immediatiately from a repeat offender and sold at auction. All proceeds should go into an educational or recovery trust fund for victims of drunk driving offences. Victims should be able to apply for grants for formal education or other applicable costs related to recovery or what have you.

There's lots of great solutions out there.

Wisdom at its finest. Wonder how log it will take this super calm, super skilled, super careful drunk driver to kill someone?

Hunh? The ones that react slowly and wander all over the road are probably impaired. The ones that drive too fast and dart in and out of traffic may be impaired or may just be fools.

And here's a hint: not stopping in winter because you're worried that you'll spin when you start up again isn't a sign of a good driver: it's a sign of a dangerous driver with a badly equipped vehicle. Get yourself good winter tires with studs and four wheel drive and put enough weight in your vehicle and you won't have trouble getting moving again. Failing to stop when necessary is stupid, dangerous, and criminal.
