Judge Gives Province Till End of June to Fix IRP Law
Prince George, B.C. – B.C. Supreme Court Justice Sigurdson has given the Province until June 30th of 2012 to propose legislative changes to those aspects of the Immediate Roadside Prohibition law which have been ruled unconstitutional. The portions of the law which dealt with those who blow over .08 were considered unconstitutional as penalties were being delivered to a person who had no ability to appeal the roadside "ruling".
Attorney General Shirley Bond says she appreciates that Justice Sihgurdson recognizes the important public-safety purpose of the Immediate Roadside Prohibition program, and the time to make the changes.
"We will work to introduce changes to the Motor Vehicle Act as soon as possible in the spring legislative session" says Minister Bond "We continue to analyze Justice Sigurdson’s comprehensive decision to determine what those changes will consist of. We are pleased that the court order upheld the constitutionality of the 90-day IRP for those who refuse to provide a breath sample at roadside when requested to do so by a police officer. The IRP program has also been found to be constitutionally valid by the court for those who blow in the warn range of 0.05 to 0.08."

Only in BC folks. Nothing liberal about this law! Immagine the decline in tourism this has caused.

So nothing wrong with this part so you still will get a suspension and your vehical towed.
So what happens now if you blow over? It’s back to the old way. You get charged with impaired driving and you get your day in court.
Bottom line is don’t drink and drive.

That’s about the same as refaining from sex because your friends girlfriend unexpectly got pregnant!
Of course the City wants alcohol at the CN Centre, and a lot of people also want to legalize pot. Will this put more impaired people on the road?? Probably.
I would suggest that the new legislation on drinking and driving is more about circumventing the court system, than it is about impaired driving per se. It costs a lot of money to process an impaired driving charge.
Should peoples right to a fair trial be tossed aside for the convenience of the Government, and to save money???
Seems that people doing a recent study on the actual deaths attributed to impaired driving were not able to get any specific statistical figures from the Provincial Government. Why would that be???
Lets keep in mind that we are dealing with a Goverment that if nothing else has a huge problem with tranparency and honesty. We should take anything they say with a grain of salt. The Judge ruled that parts of this legislation goes against the Charter of Rights. The Liberal Government had to know, or should have known what they were doing.,
In my opinion they (as usual) were trying to pull a fast one, and once again they got caught with their hands in the cookie jar.

The Law of Land is the Federal Law not something some Idiots have dreamed up in Victoria, you want to make it .o5 let Ottawa pass the Law and we all have to live by it.
Six months to “fix” a law? Almost forever getting rid of our HST? Governments do move like glaciers. Before the AGW crowd came along anyways.

How about people be responsible for themselves and just not drink and drive? If you want to chance it and get caught, suffer the consequences. Seems pretty straightforward to me.
NoSev: Yes, that’s what I’m saying. There is no reason to take a persons car away from him because they blow .05. If You can;t go fishing for a day, drink 5 beer in that time and drive home without a risk of losing your drivers license and your car — yeah–I’d say that’s a good reason to stay in Alberta and do your fishing.
The people running our government don’t give two twits about your rights or a fair trial… to them its about revenue for the inside crowd and downloading costs to those they can alienate or have no political power. At the rate we are going we will be a totalitarian state before we know it… we’re already well down that road IMO.
I agree with you Eagleone. All we can do is keep our attention on the fiberals and any others who try to pull the wool over our eyes.
