Practising Restraint In Prince George

Monday, April 23, 2012 @ 3:45 AM
Mayor Shari Green’s response to a question put to her asking her comments with respect to the City threatening an action of defamation against a local resident is a bit over the top.
Speaking to a reporter, Mayor Shari Green said she cannot comment on the matter because it is before the courts. Now given that Mayor Green does not comment on any event with Opinion 250, we have to rely on the accuracy of the event as relayed by other media.
Suffice to say however Madam Mayor, please do not hide behind the old chestnut, “the matter is before the courts" it isn’t.
The bigger issue however is the fact that you, acting on behalf of the City, hired a Vancouver lawyer to threaten to commence legal action against one of your constituents. So essentially you are using taxpayer’s money.  Some of those dollars  would have been contributed by the person you are threatening action against, Laurie Macintosh of Thompson Drive in Prince George.
We don’t take a position on whether the comments are actionable or not, but rather why in the world a Mayor would take it upon herself to hire a Vancouver Lawyer at the Prince George Taxpayers expense to even consider such action.
Then there is the letter written to the city lawyer by the President of the BC Civil Liberties Association, who thought the matter was of enough concern to him and his group to write a letter saying:
"BC Civil liberties Association is deeply concerned by the strategic use of the threat of defamation lawsuits by government against their citizens. As you are aware defending a lawsuit brought by a powerful litigant is enormously costly for a private citizen in terms of time, money and emotional energy. Indeed such lawsuits are tantamount to an attack a person’s fundamental well being."
Added to that, is a request to the City’s lawyer asking; under what authority this lawyer has been telling Macintosh that publication of his letters to Macintosh on the internet  is prohibited.
During a time that the new Mayor is suggesting that we should be practising restraint in the city, this action suggests otherwise.
I’m Meisner and that’s one man’s opinion.

Comments

Maybe the local lawyers told Green she’s off her rocker.

I am disgusted by our new Mayor and her decisions or lack there of. She is only looking out for herself and her business. Maybe she should re-visit her platform to jog her memory of all her promises and the reasons PG residents elected her.

I don’t see how a threat of legal action can be considered to be ” before the courts”.

I guess now anything can technically be “before the courts”.

This is very dangerous for democracy if a government official can use the courts to shut up a constituents voice. Same thing they did to the Wright Creek Road residents to shut them up… who’s next. This is a bad turn of events for PG. Using tax payer money to shut up political descent.

Obviously this is to cover for the new mayors shortcomings in leadership….

In the good old days (maybe 5 years ago) we used to get disenchanted with some politicians perhaps after half a year after they got elected – now it’s more like half a week!

That’s progress, folks!

It is sure going to take more than eleven bucks a vote for gang green to get re-elected next time around. Right now a pot hole on the ballot could get more votes than green.

I told anyone who told me before the election green was the candidate of choice for them, that they were backing an egotistical, feminist with a chip on her shoulder to office, and that the would be a huge mistake. I see I was right all along. If we had had even 1 choice that was legitimate, green would never have gotten elected. This was simply an election to get rid of rogers and not because the majority of people believed in green. If you caught most of her comments and voting directions in council it was very easy to see she is a pro business anti individual narcissistic……person.

Sad.

I am wondering why people seem surprised by the ongoing actions of the Green Machine? Prior to her being elected to her position we had numerous examples of her sketchy dealings, and I think we had a pretty good idea of how she was going to run things once elected. No surprises for me anyway, although I did hold out hope for others on the council, and the optimist I am, remained hopeful that folks like Hall, Skakun, and even Krause, would reel her in, and at the very least provide a certain level of influence. What I continue to see is a one woman show, of course there is the crew of individuals (comprised of old City money and big business primarily)that are standing behind the curtain cheering Sherry on as she hacks and slashes jobs at City Hall, and spends money that we don’t have on things that don’t really matter (to this tax payer anyway). I would prefer that a greater focus be placed on our crumbling infrastructure. I would really like to be able to drive through at least one neighbourhood without having to dodge the sink holes that threaten to envelope my vehicle if I don’t perform some unique and creative driving tactics to avoid them without ripping off important parts of my vehicle in the mean time. The optimist in me remains hopeful that come next election the fine folks of this City will let Ms. Green know at the polls that we are no longer interested in the lack of transparency she offers. Is it too much to ask for?

You know, it’s times like these when I have to hit refresh on my computer to make sure that what I’m witnessing on my screen actually isn’t a dream

With the type of behaviour that has been on display at city hall lately, someone at IPG should actually make the pitch for a new reality based TV show to bring in some dough to fix pot holes. They could call it “The Real Municipal Politicians of Prince George”. LOL.

“Governments should fear their people ,People should not fear their governments”

I seem to recall that the city decided not to clear the ditches last spring in order to save money. Sounds like the path of least resistance for the spring runoff was through this man’s property.

As the ditches for all intents and purposes form the storm sewer in these areas of town, I would think the onus is on the city to keep them clear especially when the blockages are a direct result of their snow clearing efforts.

BTW I wonder how many potholes could be fixed by what was paid to the Vancouver lawyer?

It’s really too bad Zurowski ran such a crappy campaign against Rogers the first time. If he had shown up, Prince George would be enjoying a second Zurowski term.

I was against him during the rogers election because I figure him to just be a kinsley clone, but after seeing rogers and now green, I think you may be right.

As an aside, how long will it be before the Haldi Road school kerfuffle will be no longer be “before the courts”?

Harbinger – “As an aside, how long will it be before the Haldi Road school kerfuffle will be no longer be “before the courts”?”

The Haldi Road “Residencial” kerfuffle should no longer be “before the courts” by the end of the week if all goes well.

Hmm…wonder if the city will try to put a gag order on that one? ;)

I still feel the residences of that area should not have had to take them to court. We need a municipal board desperately. This city has put enough of its citizens in
debt in terms of time, money and emotional energy to stand up for what they believe is their rights…….

Libel and Slander lawsuit? I think that would be a bit over the top. How about monetary compensation from the city because all the residents were “badmouthed” by be told they are NIMBYS, selfish, uncaring, aloof and claiming they don’t have any disregard for those less fortunate? I believe that is quite a negative label to hang on the folks that live in the neighbourhood of Haldi Road school/institution just because they disagree with their city hall.

I just can’t get it clear in my head–Is it Sheri Clark– or is it Christy Green? At any rate I believe the entire 2012 budget wouldn’t be enough to keep the Prince George electorate from expressing their honest opinion of our mayor. That is not to say that we would have anything nice to say about her behaviour.

Please let us not forget this during the years to follow as we will definitely approach our next election with a true case of taxpayer amnesia and political forgiveness and re-elect these ninnies again. Has happened.

Ah that #$%$%#* $!!#*$5 $#! (* a &^*%$!#@ (*&%$. I can’t afford to go to court for saying anything slanderess about what I think of our new mayor.

Harb: “Please let us not forget this during the years to follow as we will definitely approach our next election with a true case of taxpayer amnesia and political forgiveness and re-elect these ninnies again. Has happened.”

Your own failed kicks at the can aside, maybe some of those people believed that the ninnies you know are better than the ones you don’t?

I’ll try again if ya got $81 thousand you can lend me. But then again I would owe you and my then decisions wouldn’t be mine.

Ben is a Bencher of the BC law Society.

It is entirely inappropriate for a Bencher to be publicy stating that a litigant, yes even a public body such as the city, not have the freedom to choose any member of the bar. There are a number of reasons to choose a lawyer. There are a number of reasons to go out of town when choosing a lawyer. Most notably conflicts. Meisner admits his lack of access to the key-players at City Hall, makes him ignorant on these facts. He miraculously comes to an opinionated conclusion nonetheless. Vintage Meisner.

When Benchers of the Law Society start to argue which lawyers should, and should not be hired by litigants, a very significant line is crossed.

Meisner’s hatred of Green has caused him to criticise a decision that was most likely not even made by Green. Again, vintage Meisner.

For Bencher Meisner to publicly advocate this point is unethical. He crossed the line. He should resign from the Law Society.

One honest man’s opinion.
