B.C.'s Tobacco Damages and Health Care Costs Recovery Act has its day in court today.  The Supreme Court  will hear arguments on the constitutionality of the legislation.

The Legislation  would allow provinces to try and recover money spent on  health care for those who became ill from tobacco use.

If the Supreme Court deems the legislation constitutional, it could open a floodgate of law suits  (worth billions of dollars) against the tobacco industry.

In B.C. 16 % of the population smokes, that's the lowest smoking rate in the country, still, more than 5 and half thousand B.C. residents die from tobacco related illnesses every year.
