Prince George- It was an easy pinch.
 
Police doing routine patrols in the Hart came upon a man loading something into his vehicle. It looked suspicious and so they stopped.
 
It turned out that the 37 year old man was loading 10lbs of marihuana into his vehicle.
 
He was arrested and has been released on a promise to appear in court at a later date.
 
He is facing charges of possession of a controlled substance for the purpose of trafficking.
 
The investigation is ongoing.

I hope they seized his vehicle. But that was probably too much paperwork......
promise to show up in court. if they don't what happens. Do they automatically get arrested and kept there until the next court date, and found guilty, there precourt days are multiplied by two......

Hmmmm, if thats the case. I'm not too smart, but I would claim myself guilty, miss the appearance, go to gaol, than get double credit and be a free man earlier.




Double credit went out the window earlier this year, and you can miss two or three court appearances until they decide to hang on to yuh.
But, this case is one of those where a person may act differently if he's doing something wrong and police show up on scene.
Call it gut reaction, or a hunch, something stood out.
Buddy of mine down in squamish a few years ago decided to check a guy carrying what appeared to be a lunch bag going off shift from the plant.
What's in the bag.
My lunch.
Some lunch, fulla dope.
It was funny!
Loading 10 pounds of that looked suspicious? That much probably fits into a grocery bag or two. Maybe they were plants with tell-tale leaves.

I am really curious what was the part of loading that made that look suspicious.
Well Gus, guess yuh gotta be doing something illegal when the police show up, then you'll understand what I mean. Not that you would do anything like that, but I bet there was a good laugh around their office.
If he doesn't show up he becomes "Known to Police"

There is a rational/legal reason I ask. In order for a legal search to take place that will not get thrown out of court I understand that there has to be a court order or probable cause.

I am looking for the probable cause.

I load stuff into the trunk of my car almost every day. It is a common act by almost everyone who has a car and a driveway or a curbside parking spot or parking spot on a parking lot.

My question is what made this person's actions stand out enough to provide "reasonable and probable grounds for a specific search of that individual's property.

Here is the legal basis of my question:

"Section Eight of the Canadian Charter of Rights and Freedoms protects all individuals from unreasonable search and seizure. For a search to be “reasonable” it must be authorized by law, the law itself must be reasonable, and the manner in which the search was carried out must be reasonable (R. v. S.A.B., 2003 SCC 60). This means that the officer must be acting within the power of a valid statute, and it must be performed on the basis of there being “reasonable and probable grounds” that a crime has been committed."

Simple question I thought. But I gather not too many on here care about such trivial matters. If people wonder why things get thrown out of court, this is one of the reasons.
The term Section 8 refers to a category of discharge from the United States military for reason of being mentally unfit for service. It also came to mean any service person given such a discharge or behaving as if deserving such a discharge. The term comes from Section VIII of the World War II-era United States Army Regulation 615-360, which provided for the discharge of those deemed unfit for military service.

Coincidence? But, there is no such thing as coincidence.

The guy probably got paranoid when the cops drove by and tried hiding the ten pounds behind his back. He probably shouldn't have smoked a joint before leaving his house.
I agree with Gus. So the cops can just whip in my driveway when they see my thowing my duffle bag in my truck and search me down because they think it is suspicious? Maybe there were tell tale signs it was pot. Lets have the whole story.
Maybe it was an informant who called the police telling them this was going to be happening.

Sounds a little too cheesy to search someone who is putting a bag into a vehicle.
How and heck can a policeman trust a gangster, by having him promise to show up in court? What a joke.
I have been spending all afternoon trying to find the relationship Loki sees between unreasonable search and seizure and military discharge due to mental incapacity.

I am afraid to say I failed miserably. My mind simply does not stretch as far as yours on this one, Loki. I even tried some of my favourite mind expanders.... nothing.

Give me a hint, what is the relationship as you see it?

Once I can get a bit of clarification on that, maybe we can deal with section 8 of the BC Motor Vehicle Act which states that the Insurance Corporation of British Columbia may issue a licence for a farm tractor owned by a farmer. I mean, to me the connection with that one is obvious. ;-)
Legalize Pot --- and for the record I am not a user....just a practical and realistic citizen.

Sure, there are some downfalls to legalizatio, but the net effect on our society is positive.
I agree with you 100% LTN. I am also not a user. I do not smoke anything. Ever since I first tried smoking when I was a teen I could not inhale any smoke. The automatic reaction was to start coughing and I decided my body was telling me something I should be listening to, so I never tried to force the situation.

I agree legalize it. The current situation is an excuse to create more police state tactics against otherwise law abiding citizens.

I think if it was legal... the best way would be to keep existing laws for illegal grow ops... make it legal for grow ops that meet a health and safety standard as per proper zoning and such, and have them audited and limited to selling through the BC liquor Control Board where it is taxed.

Take the revenue from organized crime in the local markets, so that they can not have their other activities subsidized... but still be prepared to break up their operations intended for export... until such time as the Americans reflect on their laws as well, and are willing to work to snuff out organized crime that results from the Marijuana laws.

Problem is what would the CIA do for funding if they couldn't work the other side of the weed trade and had no market for the heroin and coke that they are so connected with. Maybe it would be time to get rid of the CIA and their other organizations in crime as well.

Without running the risk of verbal diarrea, it struck that s8 in the CofRaF and the military mental fitness discharge regulation and now you have added BCMVA item, there seems to be a little consistency with section 8.
