Investigation Launched Into Actions of Kelowna RCMP Officer

Kelowna, B.C. – The officer who delivered a kick to the head of a Kelowna man accused of careless use of a firearm, is now on administrative duties.
 
The incident was captured on video, and released to media. In that video, it appears the man, identified as 51 year old Buddy Tavares, was complying with police demands that he lay on the ground, although he was doing it slowly.
The video shows a police officer approach Tavares, and then kick him in the head.
 
In a statement released to media today, the Kelowna RCMP’s Officer in Charge, Superintendent Bill McKinnon says he recognizes that the community is shocked by what it has seen “I too am shocked and disappointed” but having said that, he says “We have to now allow the process to take its course.”
 
That process includes a suspension decision by the commanding officer of the division, a decision which could come before the end of the day. A code of conduct internal investigation has been requested and a criminal investigation will be undertaken by the Abbotsford Police.
 
As for Buddy Tavares, he has been formally charged with Careless use of a firearm. The charge follows a complaint that someone had been firing   a gun at a golf course, something Tavares had been permitted to do to clear geese from that golf course.

There was a permit in place for this guy to use a shotgun for bird control on this golf course, a normal duty for this guy.
He does what he is supposed to under permit, gets arrested, assaulted then charged with careless use of a firearm. The shotgun even had the trigger lock installed when it was removed from Buddy's truck and confiscated by the cops.

I'll sure sleep better knowing who's out there arresting the bad guy's.

Yeah I agree sparky I say kick the cop in the face like he did to this guy. I think all cops need to be beaten to a pulp so that they know how it feels to be a victim and maybe just maybe we won't have bullies for law enforcement.
I disagree. I had excellent polite service from some RCMP officers and I am not going to let one bad experience cloud my judgment.

If I would see a cop in trouble being beaten by some hoodlums I would do my best to come to his or her aid.

Well said Dragonmaster (both comments)!!! The RCMP are back tracking & covering their butts now. They probably charged the guy just to make it look more like the kick to the head could have been justified.
It is sad that as of late that thre have been so many bad news items on the police forces. I am lucky I guess as I know many very good, honest, caring, credible police officers.
There have indeed been som very bad incidents that have happened. And yes is sure throws a bad light, and part of the hype is the press, who will milk a police incident for every thing it is worth and for as long as they can.
I say walk a mile in their shoes before you make judgement on them all...
I don't think there are any jobs out there who don't have the bad ones as well as the good.... you just don't hear so and so was a doctor or so and so was a chef or a techer or a street sweeper...
In this case, from what I have seen on the news, and not hearing the police officers side, it sure doesn't look good...the take down i had no problem with , the kick, that makes me scrach my head real hard...and if that police office did wrong, he deserves what he gets....

The other instances are being dealt with wherever they happened. And they are as regrettable and inexcusable as this recent one in Kelowna, and that is what this story is all about!

Somebody posted a comment that all cops should be beaten to a pulp. I commented not to go overboard because this one officer lost it according to the account related above.

Read somewhere else that he had a permit to scare off geese. I think that was during the summer. I doubt he was scaring off geese this time of year.
Haven't seen the video. I don't believe kicking him in the head was the right thing to do.
Was there a brief chase before this? What happened before the witness started the camera rolling. Adrenaline can make things happen quickly. If I thought I was going to face someone with a shotgun my reaction would be far worse than the RCMP officer's.
That's why I'm not a cop.
I think it's about time someone investigated who is doing the training for these officers.

This has to be starting somewhere,there must be some kind of screening process in place when officers are being trained,or is that the problem? There is no screening?

Boomer, I live on Vancouver Island and I saw a field full of geese on January 4th. They are indeed present in BC down here right now. If you view the video you will clearly see the victim complying with the order to get on the floor and the police officer walking up to him and kicking him without a pause. From the video there doesn't appear to be any excuse.,

Even so, how many RCMP are like this? How many incidents in the last couple of years, two or three dozen, perhaps. How many RCMP officers are there, how many tens of thousands? Keep the frequency in perspective, and punish the perpetrastors of violence, RCMP or not.
95% of any workforce do their jobs well, don't have to rely on a shop steward to help them out of a jam.You've all heard of the ones in different jobs who've been fired.
Gonna get bad apples in any barrel and yah, you don't hear of the chef, or pipefitter who beat someone to a pulp.
I really can't see this constable staying in the Mounties after this, he's a disgrace to the uniform.
You can have the best screeners interviewing recruits as we do have in PG, and you're still gonna have some slip by, because it ain't an exact science.
Prince George, you're right, if I saw a member getting beaten, I'd be in there like a dirty shirt helping him out.They ain't all bad, people. Get a grip.
I am not defending the actions of this officer, or of any other. I must point out though, that given the temptations and situations faced by officers on a daily (sometimes hourly) basis, the number who turn out to be 'bad' cops is surprisingly low.

He was no where near any gun when he was kicked in the face by a cop while doing what he was being ordered to do. Why would your reaction be worse than the cop? The cop is a coward by any definition. Kicking someone in the face while they are on their hands and knees is grounds for dismissal, (because he is a cop) criminal assualt charges and jail time no matter who you are. This cop must be fired for what he has done. The people must demand it!

Like I said i didn't see the video. Kelowna has a different climate than Vancouver Island. Anybody seen flocks of geese in Kelowna lately? Let us know. I do know that adrenaline can be coursing through your veins for a long time.
for every cop who has oversteped the line I know ten who are good people and officers...
an no I can not abide with anyone breaking the law, orsuggesting such ,like beating an office so he knows what it feeels like...

Shame on you Ben and Elaine for not monitoring this site and allowing chrislivingdowntown to post his insane comments. He is actually advocating violence towards all law enforcement people no matter what.

As for the officer who committed the deed: yes, it was excessive. Yes, he will be taken to task over it. He has been suspended and that is the first step in a series of legal actions that will be most likely brought forth against him. Will he loose his job? It depends on his work history and the position the Force takes on discipline towards him.

Could a criminal conviction for assault causing bodily harm on the officer effect his employment with the RCMP? Possibly. Usually a mandatory firearms prohibition accompanies such a conviction, so a condition of his employment (ability to possess and use a firearm) would make employment with any police force impossible. This is up to the courts.

Is the man who got kicked in the face entitled to sue the officer and the Force?
Yes. Will the legal department be in contact with the man? No doubt, but its up to the man to seek damages.
