Province Announces Full Public Inquiry Into Dziekanski Death and Taser Use by Police in B.C.

Solicitor General and Public Safety Minister John Les has  announced the provincial government will launch a full public inquiry into the death of Robert Dziekanski and the policy governing the use of Tasers by police in B.C.,

"There are a number of processes that have been launched to date, and we are confident they will be thorough. But it is equally important that we establish an open and integrative review," said Les. "Public safety and confidence demands a comprehensive and independent look at all of these issues. If B.C. and Canada are to welcome the world to our doorstep, we need to learn from this tragedy and do better."

An independent commissioner of inquiry will be identified in the near future, and formal terms of reference will be drafted at that time.

It is expected the commissioner of inquiry will commence the review of Taser use policy immediately. The commissioner will also determine the appropriate time to conduct the remainder of the inquiry, taking into
account the fact that a homicide investigation is currently underway. A Coroners Inquest is also expected to begin in the spring.

The scope of the public inquiry would include the following:

  •  Review the appropriate use and policies currently employed by police in British Columbia with respect to the Taser, and recommend any necessary changes.
  •  A full and comprehensive review of the incident involving Dziekanski, including (but not limited to) the actions of the RCMP, Canadian Border Services and immigration processes and Vancouver airport (YVR).
  • Provide further recommendations on how procedures can be improved with respect to the handling of foreign passengers coming into British Columbia through YVR.

"This incident has British Columbians, Canadians and people all over the world seeking answers with regard to not only this human tragedy, but how the province welcomes the world to our airport," said Les. "By calling a full public inquiry, we want everyone to know that all the facts will be put on the table, we will take action based on those facts and we will learn from this tragedy."

Now if only he would expand the scope of the inquiry to include all deaths caused by police officers during the last five years, perhaps something valuable could come from it.
I think what would be really useful is if the RCMP and a few others who have reasonable protocols for handling such situations in place would simply have a work to rule strike ....

They are obviously incapable of fasttracking this stuff within safe limits.

It will be interesting to see why it took so long to process this guy through Immigration. There is more to this story than meets the eye. In addition it seems that there is no direct means of communication between Airline Personel, Vancouver Airport Security, and Canada Customs and Immigration.

If this man had just been granted landed Immigrant status, and he only spoke Polish, you can rest assured that someone in the Customs and Immigration could speak Polish, or knew someone who could.

We have a multi million dollar International Airport that feeds off the travelling public, pays itself huge wages, but cannot seem to handle local problems
When and how, did the of the title of the STUN GUN, become equated with the more user friendly tittle of, THE TASER? These are, two distinctly different weapons. The STUN GUN shoots an electronically connected projectile into people. The TASER is an electric device with two probes on its front that are pushed into people. Neither of these weapons are to be shot at, or, come into contact on a persons neck or chest area
So if you are not a Canadian citizen and the RCMP kill you, there is an inquiry, but if you are a Canadian citizen they can shoot you in the back of your head and no inquiry. Makes no sense to me.
They will give the animals immunity, like the APEC goons. Nothing came out of the Hughes Commission whitewash. And lead APEC cops were represented by Queens Counsel attornies, at public expense.

A Special Prosecutor needs to be appointed to conduct an investigation. Taking the Criminal Code enforcement out of the process, will serve nobody.
Video record of a killing then there is an inquest. No video of killing, half hearted inquest. It was stated by a reporter that the decision to tazer was made within 33 seconds of the cops arriving at the scene. A judgement call with no farting around, I guess.
I'm very disappointed in Stockwell Day and the Conservative government on this file. Stockwell says he finds it acceptable that a 3% kill rate in the use of tazers is an acceptable rate and he sees no reason why the federal government should do its own review of the use of tazers.

It is mind boggling that the man in charge of public safety in Canada sees the violation of ones rights that results in a death at the hands of police as a simple statistic that requires a higher level of deaths to become a relevant issue for his office.

He then went on to compare the Robert Dziekanski police homicide to the completely unrelated Alberta cop killer incident as his reasoning and justification for his position.

Stockwell Day still does not get it….
REALIST maybe we should make Kevin St. Arnaud's and Ian Bush's and Robert Bagnell's and...and...and...and.. cases international more so than what's been done already. Other countries seem to care about us more than our own. The 5:00 news tonight said the immense pressure put upon Robert Dziekanski's case made things happen for public inquiry. I guess we need to apply more pressure. 70 more tasers are on their way! Yikes!

Jacksonville police: man dies after being Tasered during struggle

JACKSONVILLE, Fla. (AP) -- Jacksonville authorities say a man died after being Tasered during a struggle with police.

A Jacksonville Sheriff's Office spokesman says an officer had pulled over the man's car. But when the officer approached it, he took off running.

The officer caught up with him and during a struggle, authorities say the officer used his Taser to subdue the suspect.

Rescue workers checked the man and cleared him to be placed in the back of a police car. The sheriff's office says he then became unresponsive. He was taken to the hospital where he was pronounced dead.

An autopsy is planned. The man's name has not been released. It's not yet clear why he was pulled over.

Gordon Campbell's retoric on the news tonight came only because of public pressure and the fact that he has an election to face in a year and a half.
No way they wanted to do this, but it shows us that if we stand up and make enough noise,we CAN make a difference,because the ONLY thing these overpaid carpetbaggers fear is the ballot box!
Another prime example of the mentality we have to deal with is Stockwell Day...now THAT guy is a total embarrassment!
Unfortunately,it all comes a bit late for some other unarmed citizens who have died at the hands of the police!

Taser Int is on solid ground in saying that low amperage charges, don't cause cardio arrest by electrocution. However, persistant involuntary contractions of the heart muscle, must be the cause of these Taser deaths. Taser has been pointing the finger at Cocaine, heroin, and even caffeine as the proximate cause of Taser related deaths, and they deny that induced muscle contractions are even a Remote cause. However, the fact that over 1 in 20 targets die, reveals that it is foolish to state that the causal-link issue is settled. Dirk Ryneveld's (former Deputy Regional Crown Counsel) OPCC goofs didn't help with their lame report on the issue. Surely, there is sufficient cause for suspending use of Tasers.

Taser Int has 11,000 clients; the issue here is big money v social marginals. I wonder who our convict Premier will favour? Not that Carol James (hubby is a cop)and cop friendly criminologists, Jenny Kwan and Mike Farnsworth are any better.
So much is said on here about police having to protect themselves. I have no doubt that they should try to be as safe as they can be but not at any cost.

Here is some information about dangerous jobs. To some of you, this is not new, especially for some of the work due to the location we live in.

When was the last time that 1,000 or so tree fallers from across the country came to a funeral for one of their own who died falling a tree so that we could read our newspaper?

We have pomp and circumstances for those who die in support of our country and those who keep us more or less safe from Polish Immigrants, and those who keep our buildings safe from the fire next door. In fact, we generally have pomp and circumstance for those who do their work in military-like uniforms.

Those others who are the real heroes when it comes to putting their lives on the line so that we have more products and services really do not get noticed.

Try telling a logger or a fisherman or a steel rigger that 4 RCMP resorted to a Taser when confronted with someone who was armed with a stapler ……. Too many donuts they’ll say …

EDS is a medical emergency that is fatal if left untreated. Persons experiencing an episode of EDS will be paranoid of things in their environment. In addition, their behavior and demeanor will appear irrational, psychotic, agitated and combative. They may also exhibit super human strength. These symptoms are not gender specific. Very often, they also rip off their own clothes. Why? As a result of the delirium, the “excitement” and the intense physical activity they are engaged in, the subjects are developing dangerously high internal body temperatures. In addition to creating dangers for others while in this state, the subjects unwittingly are creating great danger to themselves.

We are all aware that the normal body temperature is 98.6 degrees F. For persons suffering from EDS, their internal body temperature (sometimes hours after their death) is in the 106 – 107 degree range! Neither the human body nor its organs can function at those temperatures. As a result of these extreme temperatures, the body and bodily functions begin shutting down. With the rising temperature, the subjects reach a point of no return. If they reach that point, regardless of what they do (run around in circles until they collapse), what is done to them (stun them with 50,000 volts from an ECD or tackle and handcuff them) or what medical intervention is attempted (pack them in a bed of ice or push “iced” saline into veins), they will die. It is inevitable and it cannot be circumvented. An irreversible chain of events begins once the temperature reaches a certain level. This cause and mechanism of death is not a recent phenomenon...

Tasers are supposed to be used as a weapon of second last resort, replacing the last resort weapon of a firearm or gun, which of course is still an option if the taser fails to subdue the individual.

That is why a search for an alternate weapon resulted in the development of the taser.

Tasers should be used only if all other methods have been exhausted, such as negotiation to calm down the situation, etc and when there is immediate physical danger to law enforcement officers and others nearby, hostages' lives and so forth.

All the rules are in place and known to those who are licensed to carry Tasers.

The inquiries are (amongst other aspects) for the purpose of determining whether the use of the taser and two applications of it were indeed justified in the incident at YVR and if all other options had been tried without any result.

It's an old question I know,but what did the RCMP actually DO before there was Tazers to solve their problems??
We know what they did.

Something puzzles me here about the way this whole incident went down.

We all saw the video, we saw the man get shot with a tazer, and we all saw him go down, and the cops all tackle him. Apparently one cop kneeled on his neck with the full weight of his body on the knee, cutting off Robert's air supply, until he apparently fell unconscious from lack of oxygen.

Then, when he ceases to struggle, the cops get up, and one checks his pulse ( it appears ) and somebody utters "code red", when I assume they've discovered he's no longer breathing.

So what do they do next -- they stand around and watch him die !!

Are not our police trained in at least basic first aid ???? Why didn't one of them attempt to get him breathing again ?? Even level one first aid gives you the skills to do this life-saving manoever !! Why did they just let him die ???? In my opinion they had they skills, and the time to save his life, and did not use them.

This, to my way of thinking was the most unforgiveable act.
Imagine getting up every day and going to work to deal with people who break the laws, kill people, injure people, lie, steal, break and enter, violate the rights of others, create disturbances, act irrationally, behave unacceptably and/or are a threat to the peace and safety of others. You never know what you may face. You are never really sure how any purpetrater will react or behave. Most are acting irrationally anyway because of a number of potential factors. Top it off with the entire population watching every move you make and expect you to do the right thing everytime without being fearful, or angry, or impatient, or anxious, or ????? We've heard a lot about "excited delirium" and how it is responsible for tazer deaths. It is interesting to read about what it is - or is not. Apparently it is not even a validly recognised disorder by the US group that defines mental disorders, and we all have seen how that group defines every single little problem as a mental problem ad nauseum. For some reason, however, this one is not listed. It appears that it is just a pulp fiction to explain away unpalatable events.

That's why Chester when they enter a situation I feel they should assess it first. They cannot act that paranoid and assume everyone born on this planet is out for their or someone elses blood. It is criminal to think that just because someone has their emotions all out of control that they must be abused and taken down. This deadly mentality needs a makeover. The fear of the unknown is killing innocent people.

Actually, believe it or not, the police are not the only ones who work in such situations. Others are simply given better tools to deal with them. They have post grad degrees and clinical experience in how the human mind works, more or less.

The list you have is a bit diverse and you make it sound as if killers are as common to work with as are liars, for instance.

Lawyers, social workers, psychologists, psychiatrists ....

Actually, if one accepts the fact that some people have EDS, whether recognized by psychiatrists and psychologists and social workers and jail guards and police or not, then one must understand that not all are able to make that diagnosis. There are such things as false positives. In other words, the symptoms are similar or the same, but it it’s not EDS.

Since police are not health professionals, they should, when they encounter a situation where they think the individual may have EDS, call on a health worker experienced in such matters to deal with the situation. From what I have read of EDS, those individuals are not prone to maiming or killing people. They are more prone to vent their anger on inanimate objects.

BTW, the recommendation to call in the assistance of health professionals is on a police web site as part of the method of dealing with these situations.

CPR must be applied immediately, every second counts. I think that the penal code has consequences for those who fail to render assistance in a situation such as this one.

Robert was on his own the minute he stepped off the plane onto Canadian soil, wandering around lost for 10 hours without security noticing him and investigating what was going on.

So much for airport and border security! Scary.

Nobody and nothing worked in his favour.

The guy they just nailed in Chilliwack really looked beat up, and while he may have been violent,it is the same old story.
First, they tazer him...nope,didn't work.
Next, they Pepper spray him...nope, that didn't work either.
Try the billy club...nope, still standing.
So only THEN do they do a physical takedown.
So why didn't they just do that in the first damn place like they USED to be trained to do??
What,they have to try out all their toys??

I have seen footage of a female cop actually taking down and cuffing a big guy because she was TRAINED to do it, and it CAN be done!

I wonder what the "full" stands for? Full of what? Wasn't there at least one "full" inquiry into the recent running of the B.C. ferry head-on into an immovable object (a large island) and everyone is still "full" of questions as to who didn't do the job that they were expected to do and getting paid for?

Who was at fault? Who was not on the bridge as required? Who was not fully trained? Why not? Who was not telling the truth? Two people refused to testify apparently. Two people lost their lives and an expensive ship is resting on the ocean floor...o.k., it must have been just a *superficial* inquiry, leaving so many questions unanswered!

Wouldn't it be wonderful if at least in this taser incident we could get some real full answers and someone would be held responsible?

I am not holding my breath fully waiting for that.

RCMP in the okanagan were finally able to take a man into custody after batons, pepper spray and finally a tazer had no effect.
lmorg, your not to familiar with BCs geography are ya. Chilliwack, where the tasering, tear gas, baton, arrest took place is one hell of a way from the Okanagan. Additionally, the subject is near death tonight, I don't think they expect him to survive. In order to save you from going on another fishing trip, as your attempting with Robert Dziekanski. Yes, this subject is well know to the police.

It developed over the years into the a device that shoots two wires, although the old cattle prod style thingy is still in use as well. It must be pushed against the skin of the person, or animal.

Taser sounds more advanced, sophisticated and benign alright, more politically correct!

diplomat, unknown to me until today. Once the STUN GUN has been deployed into or onto a person, the electrical charge has a duration of approximately 2-3 seconds, immediately upon this charges conclusion. The cop at the control can now deploy the charge at his will, for as long and many times he so wishes, simply by pulling down on the trigger. This weapon is barbaric, along with the ass holes that are using them.
Was the guy from Chilliwack just out walking his doggie? I can't wait for the balanced reporting on this one.

chilako-pete, well, I gotta admit, I never knew squat about them, until a few days ago, but I'm learning. I never realized that once the probes were shot and embedded into someone, the charges could repeatedly be deployed at will. I assumed one shot, one charge. Now, tell me, are you one of those gifted ones, that come into the world already pre-programmed with a head full of knowledge, and hair already grown around your nuts.
Hey furball, D did 5 yrs in prison for armed robbery prior to coming to canada. And so what if I got the exact city wrong..still happened and the tazer didnt work.
Just as an aside, if this guy was a convicted criminal, couldn't speak english or french, and didn't have a job... why was he allowed into the country?
