Federal Court Orders All Documents in Foreign Mine Workers Case

Friday, December 7, 2012 @ 4:04 PM
Vancouver, B.C. —The Federal Court has  issued a ruling that  HD Mining disclose all documents related to the permits to bring  temporary foreign workers  to the Murray River Coal mine.

B.C. Federation of Labour President  Jim Sinclair  welcomed the news "I’m disappointed that unions are forced to rely on courts to obtain these documents; while the federal government wastes taxpayer dollars trying to keep this information secret,” Sinclair stated.

“It’s been hard to believe in the five years since the Murray River mine was first proposed that the company and our governments could not recruit and train the required workforce,” said Sinclair. “These jobs aren’t temporary and the workers attached to them shouldn’t be either.”

Sinclair also noted that despite comments by federal Human Resources Minister Dianne Finley that suggested the Harper government was committed to a review of the Temporary Foreign Worker (TFW) program, there has been no action. Despite numerous correspondences from the BCFED and BC unions requesting terms of reference and an avenue to participate in a review, there has been little in the way of a response.

“The public understands that the use of TFWs is not about a shortage of workers, it’s about lowering wages,” Sinclair said. “It’s time our governments lift the veil of secrecy over this program.”

“Long-term labour shortages require ongoing training and commitment to real immigration that allows all workers the same rights, no matter where they come from,” added Sinclair.

When we have to look out for our own rights to this extent in this country we know that we have a government which may be incompetent, uncaring, or not looking out for our interests.

Here is the oath the Prime Minister takes when being sworn into office. I, (name), do solemnly and sincerely promise and swear (or declare) that I will truly and faithfully, and to the best of my skill and knowledge, execute the powers and trust reposed in me as Prime Minister, so help me God.

Ministers are sworn in using the same words.

Many countries in the world go considerably further than that. For instance, this is the one for the Republic of Croatia.

I solemnly swear to perform the duty of the President of the Republic of ——— conscientiously and responsibly, to the benefit of the ———– people and all ———- citizens. As a Head of the ——— State, I will keep the Constitution and laws, care for the respect of the Constitutional order of the Republic of ————– , cherish proper and fair action of all bodies of state authority and keep the independence, existence and unity of the of ———– State. So help me God.

I think if we have to endure this kind of manipulation from the people who are supposed to keep our trust, it is time to revisit that trust and ask for there to be a new, more specific, oath of office since they do not appear to understand their position and responsibility to the people in this nation of Canada.

Gus. Was the Croatia swearing in before or after the Croatia/Serbian war??

All Countries have fine sounding constitutions, and swearing in ceremonies, however Countries (like people) should be judged by thier actions, rather than words.

If all people can find fault with is a few temporary chinese workers in a mine in North Eastern BC, or some babble about a the cost of Airplanes for the Canadian Armed Forces, then I think we are probably getting along fine.

We know why to companies want cheap labour.

We know why the Unions want the jobs to pay union wages, and to be union jobs.

We know that Governments, ie; left leaning Liberal’s or NDPer’s support high wages, and low productivity.

And we know the difficulty that the **Iron Lady** Margaret Thacher had with the non producing, heavily funded coal miners union in Britian.

So whats the answer?? Is the issue only about union jobs and wages??? If so lets unionize the Chinese Workers and pay them full scale and get on with the job.

So Palopu you are against Canadians, union or none union, having those jobs.

What happened with the coal miners in Britain was an example of what happens when having ‘a job’ is elevated to a status superior than a continued need for the product.

Why, at a time when the price of coal is supposedly falling internationally, do we want to open another mine with lower cost foreign labor, when all its production will do is make it more difficult for other mines already in existence, employing Canadian miners at good wages, to continue doing that?

As with most issues the facts seem to get clouded! This is a bulk sample which requires temporary skilled workers! The union can not provide those workers without spending more time training them than the the length of the project! If the short term work is successful and a full blown project goes forward it will be with union workers! If you have to train temps and the project is not there!, well you just tripled your cost and have nothing to show for it!

If these temporary workers somehow become full time workers, without every other avenue exhausted then we have a problem!

Come on now Palopu… its obvious the conservatives do not represent Canada… look at the recent privatization of key oil and gas resources to state owned corporations… Harper set the stage with his free trade and investment deal with China… realizing he couldn’t turn the deal down without paying compensation under an agreement he himself brought to life, backed into his own corner he sells out his nation and gives in to the Chinese with yet more promises this will never happen again (thereby saving his own face on the deal) and yet no details into how these deals will be assessed in the future… his corrupt investment deals stays in place and next time it will be a provincial government stuck with the liabilities when unlike Harper they are not willing to sell out the nation.

Its disgusting politics for personal gain at the expense of Canada and its no different than this deal to allow Mandarin workers to take Canadian jobs.
