First Nations Take Enbridge Opposition Case to UN

Vanderhoof, B.C.- Next week, a special envoy from the UN will be in the region to investigate the human rights situation of First Nations peoples in Canada and will look at a complaint from a group of First Nations.
The Yinka Dene Alliance accuses the BC government of violating international law by issuing permits to Enbridge Northern Gateway Pipelines “for drilling and tree removal” in their territories.
The members of the Alliance oppose the pipeline and have made a 15 page submission to the UN Special Rapporteur on the Rights of Indigenous Peoples.
The Alliance says it has called for government to government meetings with Premier Clark on the proposed pipeline, but to date, no such meeting has been scheduled.

Does this mean we can look towards the UN, to help the taxpayers with paying for all the social programs the First Nation enjoy.

All these “First Nation’s Nations would be wise to having all 51 or more (overlapping) of them here in BC apply to the UN for a voice (fulltime) and a desk too to represent them when it comes to dealing with the “Nation of Canada”. If the “Freemen” can set up an embassy in a rental unit belonging an old lady, why not First Nations folk? The then First Nation seats in the UN can be backed up by Iran, Iraq, Saudi Arabia, Russia and China. They all care for their people as much as Canada does? Who’s yer friend, eh?

The Harper and Christy show are turning the Joint Review Panel (JRP) into an obsolete joke! Imagine “issuing permits to Enbridge Northern Gateway Pipelines âfor drilling and tree removalâ in their territories.”
Enbridge must be very confident (100% sure) that the JRP will be recommending approval of their proposed pipeline to spend money on their “proposed” pipeline right-of-way drilling and for tree removal. Maybe they know something we don’t? Something stinks badly here and it’s not just Tar Sands Oil.
Harper has made a compete joke of the Environmental Assessment Review process… we don’t even live in a democracy anymore, and no one seems to care!
I say bring in the UN, we have stopped being a democratic country and need protection from Heir Harper and his Gestapo.!!!

The UN has no jurisdiction in Canada.
I doubt that this geotech drilling has anything to do with Enbridge. Its more likely geotechnical drilling for LNG routes as this has been going on for some time. I checked the reason for decision database on the lands site and nothing has been approved for Enbridge.

Even if this drilling was (it could very well be) for enbrige the govt still needs a proper assessment through condemnation drill results in order to make an informed decision.

Easy to say, but not quite true. There is a notion of universal jurisdiction which has been evolving over recent time.
It expresses he opinion that no state should be a safe haven for those who have committed genocide, crimes against humanity, extrajudicial executions, war crimes, torture, etc.
It does not even have to go through the UN. An example would be the USA’s “Protect America Act” which asserts jurisdiction over terror-suspects on a worldwide basis.
As they say, might is right, both in that case and in the case of Canada versus its aboriginals.

The UN Declaration on the Rights of Indigenous Peoples was adopted by the General Assembly in 2007. 144 nations voted in support. 4 nations voted against – Australia, Canada, New Zealand and the USA. All were the colonial “children” of mainly the UK, France and Spain, all of which voted to support the declaration.
The four countries have since endorsed the declaration. The Harper government of Canada adopted it in 2010. ;-)

I doubt the UN will directly intervene at this stage, however First Nations are smart in providing information to the UN on the Aboriginal rights infringements early in the process. It will serve to show the UN that they are within their rights to assert ever increasing methods of resistance to protect their rights!

We do not know. The declaration was signed in 2010 by Canada. In reading some background material of why it took so long it was because the four countries have a bit of a unique situation …. although there are many more new world countries in North and South America. Even some Asian as well as African countries could be considered as such in the application of that declaration’s intent.
The concern is that the words were not well defined …. guess it simply has to go to court if anyone wants to test the meaning of the words.
As is frequent in such cases, it comes down to goodwill and equity.
In my opinion, having the government make decisions for First Nations at this time in our history does not bode well.

The one I am most concerned about is whether a subsidiary or contractor could file for a permit, in which case it would be easy to hide.

It would have to have a land act tenure or special use permit issued through lands. Oh wait. It could have been issued through the oil and gas commission. I don’t even have the will or time to navigate through that site. Ether way the drilling has to be done in even if before a decision is made on the project. Even if the project isn’t approved the drill sites are low impact and easily reclaimed.

I just used a 250 news article that states the opposite of your assumption that the proposed drilling and tree clearing is NOT pipeline related. If you think that 250 news is wrong and you are right, wouldn’t your argument be with 250 news and not me?
I, and most people, are just looking for the truth northman, either the drilling and tree clearing is directly related to the proposed pipeline, or it is not related at all to the proposed pipeline.
It would be nice if Enbridge could confirm this themselves, but we all know how “open, honest and transparent” they can be… right Enbridge?
Sorry for posting so much, but I just thought of another authoritative source that could confirm to us whether Enbridge’s tree clearing and drilling is related to their proposed pipeline. 250 news should be able to get that information from good ole Bond or Zimmer.

The UN?? seriously? That institution has lost all credibility years ago. Mugabe the human rights warrior will be all over this.
To some extent I would distinguish between the UN as a whole and its Human Rights Comission. The UN does many worthwhile things, but the UNHCR has very little credibility since it is dominated by countries with poor human rights records. It serves mostly as the UN’s main forum for the expression of anti-Semitism.
The value of bringing the situation of First Nations in Canada to the attention of the UN is primarily the publicity, not the possibility of coercion by the UN or even the minimal moral force of the UNHCR.
Just because other countries have ‘worse’ human rights records than Canada is no excuse for us to justify violating human rights! We are Canadian and should treat all Canadians with dignity and respect simply because we all want to be treated that way

I don’t suppose that has anything to do with the entire creation of the state of Israel and the treatment of the Palestinian people since that huge mistake made by the British.
Given the time in history compared to most other colonial endeavours by such old colonialists as Britain I would think Israel and whoever else participated in that whole process ought to have some responsibility for what has happened there and continues to happen.
I wish there were a term such as anti-Semitism Canadian aboriginals could use when speaking about those who came across the seas to take over this land without providing them with some sort of statehood. A word which conjures up such disdain.

I thinks we are ultimately talking about basic human rights as listed in the UN Declaration on the rights of Indigenous Peoples. The Government of Canada signed on to this declaration on November 10, 2010.
I like the following quote on human rights made by Martin Luther King Jr. :
“Commit yourself to the noble struggle for human rights. You will make a greater person of yourself, a greater nation of your country and a finer world to live in.”
I do NOT like the following human rights quote made by Stephen Harper:

Remember when Enbridge said that if they could not convince people along their route, then they would abandon their proposal?

That is why I like the Governor of New Jersey, Chris Christie. He is not afraid to use words like stupid if he thinks people are stupid. He tells it like it is.
BUT, he is also a very compassionate person, and a very humble person.
